We are here to guide you through every step, helping to bridge disputes and achieve a final resolution. It is important that third parties understand their legal rights and responsibilities, as they may need to be formally joined to the proceedings, whether in parenting or property matters. A third party can be joined by a spouse party or may apply to the Court for a Joinder of Parties themselves (a legal process in which a third party is added to ongoing court proceedings). When a grant of Legal Aid is made, Legal Aid arranges for one of their in-house lawyers or a private lawyer to provide the individual with representation.
Both are crucial in separation or divorce, as all parents—biological, adoptive, or same-sex—are responsible for providing adequate financial support. Our practitioners understand the complexity involved in dividing property following separation. Whether you are in the early stages of negotiation, or need a settlement agreement to be legally documented, we will advise and support you throughout the process.

Each party has the right to obtain their own legal advice at any stage of the family dispute resolution process. We call the family dispute resolution practitioners who facilitate conferences 'chairpersons'. We have other family dispute resolution practitioners who oversee our case management program. Usually, this service will only involve one or two meetings with a Family Legal Advice Service lawyer. If you want to get more legal advice, you’ll need to either apply for legal aid or pay for the advice yourself. In 2017, we initiated a review of the CLSP to ensure it aligned with current expectations regarding the planning and delivery of legal services and accountability for expenditure of public money.
So we handle all family violence cases, child custody and interventions using a process which is in a highly-proficient, safe and secure environment. If a member of our team isn’t available in person, they will be available to provide telephone support. Our free Legal Helpline is available for preliminary information, general advice and referrals. Advice is usually restricted to a client's basic legal rights and obligations about a particular situation. If the problem is too complex or too lengthy for a phone call, a client may be offered an appointment at a Legal Services office or referred to other sources of assistance. We may also be able to provide advice on other legal issues depending on the circumstances. Our Youth Law Centre is a specialised service to help young people under 25 with legal problems. Succession law governs the distribution of a deceased person's assets and property, primarily under the Administration and Probate Act 1958 (Vic). To avoid intestacy (where a person dies without a valid will in place and the  distribution of their assets is determined by the law), it is crucial to ensure a will is valid and reflects your wishes. If an agreement is reached, the Registrar will issue interim or final orders. If no agreement is reached, the matter will proceed to the next stage of the Court process.

Our divorce lawyers in Canterbury provide support for all types of separation, such as divorce or civil partnership dissolution. If you apply for legal aid to go to court, and we think a mediation might help, we may require you to attend a mediation first. Lawyers receiving a grant of aid are responsible for drafting any agreements reached at the conference.
